Reporting to the Head of Financial Crime Compliance Anti-Bribery &Corruption (ABC), the Senior Manager Anti-Bribery and Corruption will implement the Anti-Bribery &Corruption and global risk management framework to meet legislative and regulatory requirements within Canada. This individual will provide Anti-Bribery &Corruption advice to LCOs and to the business units across the region on AB&C risk associated with prospective business, products and service and design mitigation controls and strategies as appropriate. This individual will participate in the review and investigation of potential breaches from across the Region, reviewing the reporting made, and escalating where appropriate to the Head of FCC Anti-Bribery &Corruption.

Impact on the Business

  • Stay at the forefront of key regulatory changes to ensure proactive communication with business and implement appropriate group policy and framework to manage the changes.
  • Collaborates with the Head of FCC Anti-Bribery &Corruption in preparing reports for senior management and the board.
  • Coordinate the aggregation and reporting of metrics across business lines and monitoring of trends using data from the Gift and Entertainment Tracking System (GETS).
  • Collaborates with the Head of FCC ABC in resolving audit and compliance testing findings in a timely manner.
  • Conduct risk based reviews of clients for ABC risk and provide assessment and makes recommendations to the Head of FCC Anti-Bribery &Corruption.
  • Conduct client reviews using negative media search tools such as Dow Jones, Worldcheck, etc. with the ability to make sound judgements on information found and to be able to make recommendations based on the analysis of the research results.
  • Perform testing of business units compliance with ABC policies and procedures as the second line of defence.
  • Deliver ABC training sessions to staff across business units and other functions across the enterprise as needed.
  • Collaborates with the Head of Anti-Bribery &Corruption in conducting the ABC risk assessment process for the enterprise and assist in the preparation of the report detailing the results of the risk assessment.
  • Remedial action of all material FCC AB&C issues involving the Region that arise to ensure effective implementation, through internal and external reviews.
  • Assist in the delivery of training on AB&C risks for all business products, services across the Region.
  • Contribute to the development and implementation of programmes to quantify impacts and implement actions to address, manage and mitigate impacts of AB&C risk associated w/ day-to-day activity within the Region

  • Contributes to the reporting on a country wide basis to the Board (and, as necessary, regulators) on AB&C issues.
  • Ensure that the Head of FCC Anti-Bribery &Corruption is appropriately advised of material Regional AB&C issues

Major Challenges

  • To take the complexity of the regulations on the one hand, and the diversity of business and geographies within both the Region and the countries, and achieve a balance between the demands of the regulators, external bodies and governmental initiatives and the Group’s shareholders and customers; being alive to the political, management, operational, regulatory and reputational implications of particular decisions and courses of action; assisting senior management in development of controls and systems and influencing the way in which business is conducted in order to manage these risks.
  • The incumbent is required to ensure the consistent application of the highest Risk management standards notwithstanding the complexities of products and business operations. Risk is forward looking. The incumbent would implement and drive change programmes to ensure that AB&C FCC remains in line with regulatory requirements across the Regions and Countries. A balance must be maintained between the local, regional and global priorities. The incumbent would need to balance between sometimes conflicting needs and priorities of different teams within Risk departments and across countries.

Role Context

  • The jobholder is required to work with considerable autonomy, dealing with major issues for which there is no clear cut solution while still being able to provide judgement and clear direction. Where items of major consequence are involved, reference is made to the Head of AB&C. The nature of the role requires close working contact with senior executives in FCC and across the Group, but particularly the FCC Heads.
  • As defined in HSBC Group Risk Management and Control standards, Global Functions (including Compliance) are responsible to ensure HSBC’s Risk Appetite Statement is observed. The primary role of the Functions (including FCC and RC) is as second line of defence, providing assurance, oversight and challenge over the effectiveness of the risk and control activities conducted by the first line of defence. Compliance will establish frameworks to identify and measure risks being taken by the global businesses, as well as to maintain and monitor controls for which they are directly responsible.

Management of Risk

  • Ensure compliance of both general and anti-money laundering and anti-terrorist financing (AML/ATF) compliance controls as well as operational risk controls in accordance with HSBC or regulatory standards and policies; and optimize relations with regulators by addressing any issues.
  • The jobholder is responsible for ensuring that the FCC AB&C standards are in accordance with the Global Standards Manual and that the AB&C policy aspects of the Compliance FIM are effective and relevant in conjunction with regional and country regulations.

Observation of Internal Controls

  • Maintains HSBC internal control standards, including timely implementation of internal and external audit points together with any issues raised by external regulators.
  • Jobholder is an ‘insider’ for dealing purposes and subject to strict controls and confidentiality.
  • Jobholder is required to manage Country FCC responses to adverse Compliance metrics, including unsatisfactory FCC Reviews and Audit reports.
  • This will be achieved by adhering to all relevant processes/procedures and by liaising with Financial Crime Compliance and Regulatory Compliance departments about new business initiatives at the earliest opportunity. Also and when applicable, by ensuring adequate resources are in place and training is provided, fostering a compliance culture and optimising relations with regulators.
  • The jobholder will also adhere to and be able to demonstrate adherence to internal controls. This will be achieved by adherence to all relevant procedures, keeping appropriate records and, where appropriate, by the timely implementation of internal and external audit points, including issues raised by external regulators.

Qualifications

  • Bachelor Degree or equivalent experience. CAMS Certified is highly desired.
  • 4-6 years’ experience in one or more high client risk compliance roles and/or financial services, ideally to include Anti-Bribery& Corruption experience.
  • Knowledge of Anti-Bribery& Corruption regulations and guidance.
  • Expert knowledge of process for assessing high risk clients such as SCCs, PEFPs and high risk businesses.
  • Lateral thinker with an ability to interpret and solve complex issues.
  • Excellent communicator with strong inter-personal and influencing skills.
  • Excellent knowledge of HSBC Anti-Bribery& Corruption framework, policies and procedures both for Canada and globally.
